1. Overview and Acceptance
PiggyGallery ("Platform," "we," "us," or "our") provides tools for parent-run art businesses featuring original artwork created by minor children in the household. The Platform includes storefronts, payment processing, coordinated shipping through a mail processing partner, expense tracking, and optional payroll and reporting tools.
By creating an account or using the Platform, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
2. Definitions
- "Seller" means the adult (18+) parent or legal guardian who creates and controls the account, operates the business, and is responsible for all listings, pricing, and payouts.
- "Artist" means a minor child (under 18) in the Seller's household whose original artwork is sold through the Platform.
- "Buyer" means any person who purchases artwork through the Platform.
- "Listing" means an offer to sell artwork posted on the Platform.
3. Eligibility
Sellers: Must be at least 18 years old and the parent or legal guardian of the Artist whose work is being sold. Sellers are solely responsible for operating the business, including all account activity, listings, pricing decisions, and compliance with applicable laws. The Platform currently supports sole proprietorships only.
Artists: Must be minors (under 18) who reside in the Seller's household. Only original physical artwork created by the Artist may be listed.
Buyers: Must be at least 18 years old.
4. Artwork Requirements and Content Standards
All artwork listed on the Platform must:
- Be an original physical work created entirely by the Artist (the minor child)
- Be created on paper, canvas, or similar physical media
- Not be created using digital tools, AI assistance, or generative software
- Not contain copyrighted characters, trademarks, or intellectual property of third parties
- Not contain inappropriate, offensive, violent, or adult content
- Be appropriate for all audiences
All listings are subject to review. We may reject, remove, or require modifications to any listing at our discretion.
5. Platform Limits
Pricing: Sellers set their own prices. Listings have a minimum price of $250 and a maximum of $9,999 per listing.
6. Shipping and Verification
PiggyGallery coordinates shipping through a mail processing partner to protect privacy and confirm artwork identity:
- Shipping: After a sale, the Seller must ship the artwork to our mail processing partner within 14 days.
- Identity Match: Our mail processing partner photographs the artwork and PiggyGallery staff confirm it matches the listing image. This is a simple identity match — not a review of quality, condition, or authenticity.
- Forwarding: Once confirmed, the artwork is forwarded to the Buyer. The order is marked complete upon delivery confirmation.
Rejected Artwork: If the artwork does not match the listing image, we may: (a) request a replacement; (b) return the artwork to the Seller at Seller's expense; or (c) cancel the order and refund the Buyer. Repeated mismatches may result in account suspension.
7. Shipping and Fees
Shipping Allowance: Sellers select a shipping allowance when creating a listing ($15–$100, based on artwork size). This covers shipping from the Seller to our mail processing partner and from there to the Buyer.
Platform Fees:
- Standard: 15% of the sale price
- Partner-referred Sellers: 10% of the sale price
Fees are deducted from the Seller's payout. We do not charge listing fees or monthly subscription fees.
8. Payment Processing
Payment processing is provided by Stripe. By using the Platform as a Seller, you agree to be bound by the Stripe Connected Account Agreement, which includes the Stripe Terms of Service.
Payouts: Payouts are available after an order is fulfilled and any applicable hold period has passed. We may place holds on payouts for new accounts, high-value transactions, or when we detect unusual activity.
Tax Information: Sellers must provide accurate tax information (legal name, address, SSN/EIN) as required for IRS reporting. We will issue Form 1099-K as required by law.
9. Transaction Review and Fraud Prevention
To protect the integrity of the Platform, we may review, delay, hold, or cancel any transaction that appears to involve:
- Self-dealing or transactions between related parties designed to manipulate sales volume, earnings, or referral bonuses
- Fraudulent, suspicious, or unusual purchasing patterns
- Violations of these Terms or applicable law
- Attempts to circumvent Platform limits or policies
We may require additional verification before releasing funds. We reserve the right to place funds in reserve, delay payouts, or deduct amounts to cover chargebacks, refunds, or fees.
10. Refunds and Disputes
No Refunds: All sales are final. Due to the unique, one-of-a-kind nature of original artwork, we do not offer refunds. Buyers acknowledge this policy at checkout.
Verification Rejection: If artwork fails our verification process (does not match the listing or is damaged), we will cancel the order and refund the Buyer before the artwork ships. This is not a Buyer-initiated refund—it is a cancellation due to Seller non-compliance.
Chargebacks: If a Buyer initiates a chargeback with their payment provider, we will provide transaction records to contest the chargeback. If the chargeback is upheld, the Seller is responsible for the amount, and we may deduct it from the Seller's balance or future payouts.
Seller Disputes: Sellers may dispute rejected artwork or payout issues by contacting us at support@piggygallery.com. We will review disputes in good faith but our decision is final.
11. Payroll and Reporting Tools
The Platform offers optional tools to help Sellers track wages paid to family members working in the business and generate reports that may support Schedule C preparation.
Payroll Tool Scope: Our built-in payroll and W-2 preparation tools are designed specifically for the Seller's own children who are under 18 at the time of payment. Due to the complexity of payroll rules for other worker types, we do not currently support payroll for other family members, adult children, or non-family workers through our tools. Sellers with other payroll needs may use their own payroll provider.
No Tax or Legal Advice: PiggyGallery is not a law firm, accounting firm, or tax preparer. We do not provide tax, legal, or financial advice. The tools and reports we provide are for informational and recordkeeping purposes only. Sellers are solely responsible for their own tax compliance and should consult qualified professionals for advice specific to their situation.
12. Privacy and Child Safety
Protecting the privacy and safety of Artists is a core priority:
- No Identity Disclosure: We do not disclose Seller or Artist names, addresses, or contact information to Buyers. We do not disclose Buyer information to Sellers.
- Controlled Shipping: All artwork ships through our mail processing partner, so Buyer and Seller addresses are never exchanged.
- Minimal Child Data: We collect only the Artist's first name for display on listings. We do not collect children's email addresses, photos, birthdates, or other personal information.

13. Prohibited Conduct
Users may not:
- Attempt to identify, contact, or locate Sellers, Artists, or Buyers outside the Platform
- Use information obtained through the Platform to harass, stalk, or harm any person
- Submit artwork not created by the listed Artist
- Submit artwork created with AI, digital tools, or by adults
- Create multiple accounts to circumvent Platform policies
- Engage in self-dealing, wash sales, or transactions designed to inflate sales or earnings
- Manipulate referral tracking or create fraudulent referrals
- Use the Platform for any unlawful purpose
- Interfere with or disrupt the Platform's operation
- Misrepresent your identity or affiliation
14. Intellectual Property
Artist Ownership: The Artist (or their parent/guardian on their behalf) retains ownership of the original artwork. Upon sale, ownership of the physical artwork transfers to the Buyer.
License to PiggyGallery: By creating a listing, you grant PiggyGallery a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute photos and descriptions of the artwork for purposes of operating and promoting the Platform.
DMCA / Copyright Claims: If you believe content on the Platform infringes your copyright, send a notice to support@piggygallery.com with: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.
15. Partner Program
Approved partners receive a unique referral link. Sellers who sign up through a partner link receive reduced Platform fees (10% instead of 15%), and partners earn 1% of referred Sellers' sales.
Partner requirements:
- Must be approved by PiggyGallery
- Must accurately represent the Platform
- Must connect a Stripe account for payouts
- Minimum payout threshold: $100
We may revoke partner status at any time for any reason, including inactivity, misrepresentation, or policy violations.
16. Account Suspension and Termination
We may suspend or terminate your account at any time, with or without notice, for any reason, including:
- Violation of these Terms
- Fraudulent or suspicious activity
- Repeated artwork rejections
- Chargebacks or payment disputes
- Inactivity
Upon termination, we may hold funds for up to 120 days to cover potential chargebacks or liabilities. You may request payout of remaining funds after the hold period, subject to any offsets for amounts owed.
17. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that the Platform will be uninterrupted, error-free, or secure. We do not guarantee any specific sales volume, income, or business results.
We do not provide tax, legal, or financial advice. Any tools, reports, or information provided are for general informational purposes only.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIGGYGALLERY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
19. Indemnification
You agree to indemnify, defend, and hold harmless PiggyGallery and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit; or (e) your tax or legal obligations.
20. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
21. Arbitration and Class Action Waiver
Agreement to Arbitrate: You and PiggyGallery agree that any dispute, claim, or controversy arising from or relating to these Terms or your use of the Platform shall be resolved exclusively through binding arbitration, rather than in court, except that either party may bring claims in small claims court if they qualify.
Arbitration Rules: Arbitration shall be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Wyoming or, at your election, may be conducted remotely by phone or video. The arbitrator's decision shall be final and binding.
Class Action Waiver: YOU AND PIGGYGALLERY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@piggygallery.com within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.
22. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
23. General Provisions
Entire Agreement: These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and PiggyGallery.
Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights at any time.
